No one likes to dwell on the inevitable of growing old or the unpredictability of life, but having your wishes in writing and designating someone to carry them out is so important for your peace of mind as well as your loved ones’.

What to Expect

We are happy to answer questions, help explain the documents, and discuss what you may or may not need for your family’s future.

An initial consultation is encouraged so that you can ask questions and tell your attorney what you would like to secure. Once we have all of the pertinent information we can schedule a time for you to review and execute your documents. We can provide witnesses when necessary, a notary public, and copies of your documents as well.  Typical documents we draft daily at our office include the following:

  • Medical Power of Attorney (also known as a Living Will)
  • Deeds for real estate transfers

FAQs

The only person needed to attend is the person signing the document, not the person who will be on the receiving end. It is your choice to bring anyone with you to your consultation that you desire. However, we will need to ensure their presence is not an influence to you..

You and your spouse can make similar wills, but they will be separate wills, irrespective of each other.

The parameters for a Last Will and Testament to be valid are outlined by law in Tennessee, so preparing one on your own is risky because if you do not meet those requirements, the entire Will may be invalid.

You can, as long as it meets the requirements for a holographic Will in Tennessee: which are namely, that the entire document is in your handwriting, that it is dated, and that it can be recognized by two independent witnesses that it is your handwriting. We always suggest speaking with an attorney before executing a Last Will and Testament on your own, because any error can invalidate the entire Will and your heirs may not inherit as you wish.

We do not advise doing this at home, as it could invalidate the original Will, but your lawyer can make necessary changes as many times as you like, provided you know what you are doing and that you’re not being improperly influenced to do so.
